General Conditions of Sale

These General Terms and Conditions of Sale (the "GTC") govern all contractual relations between ARAI, a company specializing in the sale of motorcycle helmets, whose head office is located at 1 Avenue Albert Einstein, 69100 Villeurbanne, and any natural or legal person (the "Customer") wishing to make a purchase on the website.

By validating an order on our Site, you unreservedly accept these General Terms and Conditions. If you do not accept these terms, we invite you not to place an order on our Site.

1. Purpose

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of products offered by ARAI on its Site. They apply, without restriction or reservation, to all sales of products concluded between ARAI and the Customer, regardless of the clauses that may appear in the Customer's documents, in particular its general terms and conditions of purchase.


2. Products

2.1. Description of the Products

The products offered for sale on our Site are Arai brand motorcycle helmets, as well as other related accessories. The essential characteristics of each product are presented on the corresponding page of the Site, with the greatest possible precision.

2.2. Availability of Products

Product and price offers are valid as long as they are visible on the Site, within the limits of available stocks. In the event of unavailability of a product after the order has been placed, we will inform the Customer as soon as possible. The Customer will then have the option to modify or cancel his order.


3. Price

3.1. Determination of Prices

Product prices are indicated in euros (€), all taxes included (TTC), and do not include delivery costs, which are added when the order is validated. ARAI reserves the right to modify prices at any time, but the products will be invoiced at the price in effect at the time the order is validated.

3.2. Delivery Costs

Shipping costs are calculated based on the destination, weight, and volume of the package. They are clearly indicated at the time of payment, before the final validation of the order.

3.3. VAT and Other Taxes

The prices indicated on the Site include the value added tax (VAT) applicable in France. For international orders, additional taxes may be applied, including customs duties, depending on the legislation of the destination country. These taxes are the responsibility of the Customer.


4. Orders

4.1. Order Process

The Customer can place an order directly on the Site by following the following steps:

  1. Selecting products and adding to cart.
  2. Checking the basket and validating.
  3. Filling in delivery and payment information.
  4. Final validation of the order after acceptance of the T&Cs.

4.2. Order Confirmation

A confirmation email summarizing the order (products, price, quantity, delivery address) will be sent to the Customer. This email constitutes acceptance of the order by ARAI and forms the sales contract between the parties.

4.3. Cancellation of Order

The Customer may cancel his order as long as it has not been shipped. To do so, he must contact our customer service at the email address info.arai.helmet@gmail.com . Once the order has been shipped, no cancellation will be possible.


5. Payment

5.1. Accepted Payment Methods

Payment for orders can be made by:

  • Bank card (Visa, Mastercard, American Express)
  • PayPal
  • Other payment methods available on the Site

Payment must be made in full at the time of ordering. Payment details are encrypted and secured according to current standards.

5.2. Default of Payment

In the event of non-payment, ARAI reserves the right to cancel or suspend any order, as well as to refuse any new order until the unpaid balance is settled.

5.3. Payment Security

Transactions carried out on the Site are secured by an SSL (Secure Socket Layer) protocol, guaranteeing the protection of transmitted data. ARAI does not retain any of the Customer's banking data after payment.


6. Delivery

6.1. Delivery Methods

ARAI offers several delivery methods, adapted to the Client's needs, including:

  • Standard delivery: 3 to 5 working days in mainland France.
  • Express delivery: 1 to 2 working days in mainland France.
  • International delivery: 5 to 15 working days depending on the destination.

6.2. Delivery Times

Delivery times are given as an indication and may vary depending on the destination and the shipping method chosen. ARAI cannot be held responsible for delays due to circumstances beyond its control (strikes, bad weather, etc.).

6.3. Receipt of Products

Upon receipt of the order, the Customer is required to check the condition of the delivered products. In the event of damage or non-conformity, it is imperative to report it to the carrier and ARAI within 48 hours. ARAI undertakes to resolve the problem (replacement, refund, etc.) in accordance with the return conditions.


7. Right of Withdrawal

7.1. Exercise of the Right of Withdrawal

In accordance with legal provisions, the Customer has a period of 14 days from receipt of the product to exercise his right of withdrawal, without having to provide reasons or pay penalties.

7.2. Return Procedure

The Customer must notify his intention to withdraw by e-mail to info.arai.helmet@gmail.com . The products must be returned in their original condition, unused, and in their original packaging. The return costs are the responsibility of the Customer, except in the case of non-conformity or defect of the product.

7.3. Reimbursement

The refund of the returned product will be made within 14 days after receipt and verification of the condition of the product. The refund will be made via the same means of payment as that used when ordering.


8. Guarantees

8.1. Legal Guarantee

The products sold on the Site benefit from the legal guarantee of conformity and the guarantee of hidden defects, in accordance with articles L.217-4 to L.217-14 of the Consumer Code and articles 1641 to 1649 of the Civil Code.

8.2. Commercial Warranty

In addition to the legal warranty, certain products may benefit from a specific commercial warranty, offered by the manufacturer. The terms of this warranty are specified in the documentation provided with the product.

8.3. Implementation of the Guarantee

For any warranty related request, the Customer may contact ARAI by email at info.arai.helmet@gmail.com providing a description of the problem encountered and proof of purchase. ARAI undertakes to process the request as soon as possible.


9. Liability

9.1. Use of the Site

The Customer is solely responsible for the use he makes of the Site and the information he communicates. ARAI cannot be held responsible for direct or indirect damage resulting from the use of the Site or the misuse of the products purchased.

9.2. Limitation of Liability

Under no circumstances shall ARAI be liable for indirect damages such as loss of income, profit, data, or any other intangible damage resulting from the use or inability to use the products or the Site.


10. Intellectual Property

10.1. Contents of the Site

All elements of the Site (texts, images, graphics, logos, videos, etc.) are the exclusive property of ARAI or its partners. Any reproduction, distribution, modification or exploitation of these contents without prior authorization from ARAI is strictly prohibited and would constitute a violation of intellectual property rights.

10.2. Brands and Logos

The brands, logos and other distinctive signs present on the Site are protected by intellectual property laws. Their use, reproduction or imitation without authorization is strictly prohibited.


11. Personal Data

11.1. Data Collection

ARAI collects and processes the Customer's personal data in compliance with current legislation, including the General Data Protection Regulation (GDPR). The data is used to process orders, improve customer service, and send commercial communications.

11.2. Customer Rights

11.3. Data Security

ARAI implements all necessary technical and organizational measures to ensure the security of the Client's personal data. ARAI does not share data with third parties, except in cases provided for by law or with the Client's consent.


12. Force Majeure

ARAI shall not be held liable for the non-performance of its obligations in the event of force majeure, i.e. any unforeseeable, irresistible and external event preventing the normal performance of the contract (natural disasters, pandemics, strikes, etc.). In the event of the occurrence of such an event, the obligations of the parties shall be suspended for the entire duration of the force majeure.


13. Applicable Law and Disputes

13.1. Applicable Law

These General Terms and Conditions are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before taking any legal action.

13.2. Competent Court

In the event of persistent disagreement, the dispute will be brought before the competent courts of the jurisdiction of the registered office of ARAI.


14. Modifications to the T&Cs

ARAI reserves the right to modify these T&Cs at any time. The new conditions will come into force on the date of their publication on the Site and will apply to any order placed after this date.


15. Acceptance of the T&Cs

The Customer acknowledges having read these General Terms and Conditions and accepts them without reservation by validating his/her order. These General Terms and Conditions constitute a contractual agreement between ARAI and the Customer, and are accessible at any time on the Site.
